Public Policy of the Brain Injury Network
Policy approved by the Board 9-12-09
Brain Injury and Parental Rights:
We are aware that some individuals with brain injuries are being denied access to their minor children as a result of broken marriages, divorces, and custody battles. We individuals with acquired brain injuries have the right to maintain relationships with our minor children. We have the right to interact with and communicate with our minor children. Preventing contact between us and our children should only be undertaken in the most extreme circumstances. The fact that we might need to live in assisted living facilities or nursing homes is in and of itself insufficient grounds to deny us access to or contact with our minor children.
